Agreement:

You “User” are entering into a subscription agreement “Agreement” by National Construction Zone “NCZ” to use our website. User agrees and acknowledges that the following Terms and Conditions as well as the Privacy Statement that are acceptable and agreed to. The User further agrees and acknowledges that this Agreement shall be the governing body for the use of our website for both free and subscription paid information access. From time to time, NCZ may be required to update, modify and revise this Agreement and reserves the right to do so at any time and with the complete understanding and acceptance of the User. NCZ reserves all rights afforded by the state of Colorado, and of the United States. NCZ also reserves its rights, claims and defenses for any omission from the contents of this Notice and Agreement to the User of the NCZ website. NCZ reserves the right to limit and modify the number of postings, subscribers, information and other content by its own consent and discretion. NCZ reserves the right to evaluate its subscribers and postings for authenticity, however, will not be held liable in any manner or form for improper listings. NCZ must work on a best efforts basis that all subscribers and postings are legitimate and are entering into this agreement with full professional and proper understanding and consent.

Subscription Fees and Other Charges:

IMPORTANT NOTICE:

Effective 3/01/2010 and for a limited time only, NCZ has discounted the subscription fees in order to temporarily assist subscribers find construction projects during this economic recession.

1. Month to month plan: Regularly $89.99 NOW ONLY $59.99 (A minimum 3 month commitment)

2. 6 month plan: Regularly $499.99 NOW ONLY $349.99.

NCZ accepts payment for subscription and services by credit card only. Acceptable credit cards are; Visa, MasterCard, Discover, or American Express. User must provide NCZ with a valid, verifiable and authorized credit card by User and at the time of their initial chosen subscription term. User acknowledges and agrees for NCZ to immediately bill their credit card for such subscription term and services. The User also acknowledges and agrees that their initial chosen subscription term will be automatically renewed at the same term (see FAQ’s) and to allow NCZ to charge their updated subscription to their credit card on file from the initial subscription purchase. User agrees and acknowledges to pay and authorize NCZ to charge their credit card for the cost of the subscription term and services. Unless otherwise notified, the subscriber’s subscription term will automatically be updated, renewed and charged for their subscription renewal term. 

Cancellation:

User may cancel their subscription at any time.  Simply go to the home page click “Contact Us” and notify us of your request to cancel.  Please include your user name and password so we may verify your account.  A representative will then respond to your request and assist you with your cancellation.  It's that easy.  NCZ will promptly honor your request and will reply to confirm any such cancellation request by User via email. NCZ will only accept cancellations by email. User’s cancellation will be effective the first day after the expiration of their current subscription term.  Month to month subscribers are liable for their initial 3 month term and may cancel at anytime there after. 6 month subscribers are liable for their full 6 month term. NCZ does NOT offer, grant or imply any partial credits or prorated refunds to the User. NCZ may cancel a User’s subscription at anytime and without notice due to the User’s breach of this agreement; if the User should fail to make payment for their subscription when due, if the User’s method of payment (credit card) be denied or not authorized by the issuer or if NCZ shall receive negative or derogatory comments about the User's behavior or professionalism from our construction customers.

Use of “nationalconstructionzone.com”:

The use of this site is solely for the purpose of review, bidding, solicitation construction project leads obtained by NCZ in order to aid the User in their business development. User agrees and acknowledges that their use will be limited only to these areas. This site shall not be used for competitive, fraudulent and illegal purposes. The information obtained and contained within the NCZ website may not be used for redistribution or any other purpose contrary to its purpose. User may not use the NCZ website in which the security is/may be compromised. The User agrees and acknowledges not to gain improper or illegal entry nor submit into the NCZ website any electronic messages, emails, links, viruses, spams, etc. that may harm the NCZ website, our affiliates and clients that may cause damage to equipment and systems. Any such violations will be punishable by law and in accordance to the laws of the state of Colorado and the United States of America. User agrees and acknowledges that their use to the NCZ website, the information and other services provided by NCZ and through their website are at the sole risk of the subscriber. NCZ is not liable for any direct, indirect, punitive damages or any other losses incurred by the User from accessing the NCZ website.

Intellectual Property:

User agrees and acknowledges that all information posted, listed and shown on the NCZ website is the sole intellectual property of NCZ. No duplication, reproduction, transferring and any other use without the written consent of management is strictly prohibited.

Warranty:

NCZ makes every reasonable effort to ensure that all content is current and correct. However, NCZ can not be held liable for any misinformation that a posting client or subscriber may submit. NCZ must rely on the professionalism and truthfulness of its Users. Therefore, NCZ does not and will not guarantee or warranty any information service on its website. User agrees and acknowledges that NCZ does not provide any warranty nor implies that there is one. All information and its content provided by the NCZ website and its management is on an “As Is” basis and without warranty or liability.

Limitation of Liability:

NCZ in no such and agreeable terms shall be held liable in any manner for the loss of profits, business, data, accidental, incidental and punitive damages. NCZ‘s liability is limited to “ONLY” the amount of fees paid and not to exceed regardless of the type of claim. Indemnification: User agrees and acknowledges to indemnify National Construction Zone, it’s parent company, it’s sister company, it’s employees, it’s officers and affiliates against any declared claims or suits made by any third party for any damages, breach of contracts, content, data, losses or any other type of loss by the User resulting from the use of NCZ website, its employees, its officers and affiliates.

Unlawful Conduct:

User agrees and acknowledges not to use and to act professionally and respectfully when using the NCZ website. Any transmittal of illegal, profanity, vulgarism, viruses, spams and other inappropriate content, links, videos, attachments, etc. is strictly forbidden and enforced. Any such attempt or conduct is punishable by the laws of the state of Colorado and the laws of the United States of America. User agrees and acknowledges that NCZ may at any time review and monitor users and clients transmissions and other communication related to the website. Website Links: From time to time NCZ may provide links, videos and other forms of electronic media. User agrees and acknowledges that the user will not hold NCZ liable for such material. All third party forms of transmissions, links, videos, etc. are done for the benefit of users and are by no means approved, endorsed or implied to be guaranteed or accredited. All information obtained is on an as is basis and at the sole discretion of the user to perform all proper due diligence before making any decisions.

Terms and Condition Notes:

This agreement is the entire and only agreement and supersedes all other agreements whether written, oral or implied.
